The Opposite party No.2 has been granted anticipatory bail by this Court by an order, dated 13.08.2014 passed in Cr. Misc. No. 33819 of 2014. He is the husband of the petitioner and facing prosecution on the allegation of commission of offence under Sections 498A,324,307 read with Section 34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.
This application seeking cancellation of bail under Section 439(2) of the Code of Criminal Procedure, 1973 has been filed by the wife on the ground that while seeking anticipatory bail, the Opposite party No.2 had concealed certain material facts.
On perusal of the application seeking cancellation of bail, I find that there is no allegation of misuse of privilege of bail granted to Opposite party No.2. In such circumstance, I do not find any ground of cancellation of bail. This application is, accordingly, dismissed.
