JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-09-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Barsoi P.S. Case No. 108 of 2017 registered under Sections 147, 341, 323, 307, 504 and 506 of the Indian Penal Code. The accusation is that when the informant, Gulbanu Khatoon, reached at Tube-well to take water then she saw that six persons named in the F.I.R. including the petitioner putting the stake at her land. When she made protest then all accused started to abuse her. In the meantime, petitioner gave Dabia blow at the head of the informant and others also caused injury through axe and fist and slaps.

Learned counsel for the petitioner submits that, in fact,

No.39592 of 2017 (2) dt.13-09-2017 due to land dispute occurrence took place, in which, petitioner also sustained grievous injury, which would appear from annexure 4 to the application, regarding which, on the basis of written report of petitioner, Barsoi P.S. Case No. 109 of 2017 is also instituted against the petitioner and others.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar, in connection with Barsoi P.S. Case No. 108 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
