JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Madhubani Mahila P.S. Case No. 28 of 2016 registered for the offences punishable under Sections 323, 504, 498A, 379 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
On appearance of opposite party No.2 the matter was referred to the Patna High Court Mediation and Conciliation Centre by order dated 24.7.2019 and the report of Mediator at Flag 'M' shows that dispute between the parties has been settled and opposite party No.2 has no grievance and they have filed a compromise petition which is also annexed with the report of Mediator.
Patna High Court CR. MISC. No.27393 of 2019(6) dt.04-11-2019 2/2 Learned counsel for the petitioner and learned APP have admitted the above position. None appears on behalf of opposite party No.2 though signature of opposite party No.2 is in the compromise petition.
In view of above facts and circumstances, let petitioner surrender within a period of three weeks and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Madhubani, in connection with Trial No. 839 of 2017, arising out of Madhubani Mahila P.S. Case No. 28 of 2016, corresponding to G.R. No. 429 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
