Petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 341, 323, 324, 325, 307, 338, 353 of the Indian Penal Code. It is alleged that this petitioner assaulted police party and cause hinderance in discharge of police duties.

Patna High Court CR. MISC. No.27529 of 2023(2) dt.11-07-2023 2/3 It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case due to village politics. The F.I.R has been lodged against 28 named accused persons and 50 unknown persons. Allegation of assault is general and omnibus. Similarly situated co-accused persons have already granted bail by this Court vide order dated 05.12.2022 in Cr. Misc. No. 32648 of 2022.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chapra at Saran in connection with Sonpur P.S. case no 803 of 2020, subject to the conditions laid down under section 438(2) of
