JUSTICE BIRENDRA KUMAR ORAL ORDER 21-09-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 307, 120B, 504 of the Indian Penal Code and Section 25(1-B)A, 26, 27, 35 of the Arms Act.

During course of assault, co-accsued Rajesh Kumar Singh @ Chun Chun Singh is alleged to have caused firearm injury to the son of the informant in the stomach. The trial against Rajesh Kumar Singh @ Chun Chun Singh has resulted in acquittal as the prosecution witnesses, did not support the allegation, including the injured. Allegation of firing is also there against the petitioners.

No.34745 of 2017 (3) dt.21-09-2017 2 /2 Considering the fate of the trial, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Begusarai/successor Court in connection with Bhagwanpur Police Station Case No. 208 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
