Petitioner seeks bail in Bettiah (Muffasil) P.S. Case No.586 of 2018 instituted for the offence under Section(s) 30(a), 31, 35, 38, 41, 56(d) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that illicit liquor is alleged to have been recovered from the possession of Santosh Patel and Manoj Patel. Name of this petitioner has been disclosed by Santosh Patel and Manoj Patel.

Counsel for the petitioner further submits that Santosh and Manoj Patel have already been granted regular bail by coordinate Bench of this Court vide Annexure-2 and 3.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, West Champaran, Bettiah, in connection with Bettiah (Muffasil) P.S. Case No.586 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. It appears that some other cases under the Excise Act are pending against the petitioner. The petitioner will file an Affidavit at the time of his furnishing bail bond that he will not indulge in such activities in future, otherwise, his bail bond in the instant case will liable to be cancelled.
