1. Heard learned counsel for the petitioner and learned APP for the State.

2. The learned counsel for the petitioner submits that the present quashing application has been filed seeking quashing of the order dated 06.07.2017 passed by the learned Sub-Judge IX-cum-ACJM, Muzaffarpur in Complaint Case No. 2798 of 2012, Tr. No. 271 of 2017 whereby the O.P. No. 2 was discharged from the offence under Section 138 of the N.I. Act.

3. The learned counsel for the petitioner, after some arguments, submits that he is not pressing the quashing application but seeks a direction upon the learned Trial Court to expedite the trial. It is next submitted that the case is still

Patna High Court CR. MISC. No.51209 of 2017(2) dt.01-12-2023 2/2 pending for framing of charge as discharge application of the O.P. No. 2 has been rejected which has been accepted by the O.P. No. 2.

4. The learned counsel for the petitioner, after making the said submission, seeks permission to withdraw the quashing application.

5. Permission is accorded.

6. Accordingly, the present quashing application stands dismissed as withdrawn.

7. The Court expects that the learned Trial Court would expedite the trial of the case and conclude it expeditiously preferably within a period of nine months from the date of receipt/production of a copy of this order, if possible. (Satyavrat Verma, J) Rishabh/- U T
