ANJANA MISHRA ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
Petitioner is apprehending his arrest in connection with Katihar (Muffasil) P.S. Case No. 47 of 2016 registered for the offence punishable under Section 354(A) of the Indian Penal Code and Section 12 of POCSO Act.
It is submitted by learned counsel for the petitioner that the present case has been lodged only because of a land dispute with the Mama of the petitioner, namely, Shiva Paswan and certain wild allegations have been made only to humiliate the petitioner.
After considering the facts and circumstances of the case and that no case is made out against the petitioner and that he has no criminal antecedent, let the petitioner above named, in the
Patna High Court Cr.Misc. No.27780 of 2016 (2) dt.27-09-2016 2/2 event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-cum-A.D.J.-I, Katihar in connection with Katihar (Muffasil) P.S. Case No. 47 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
