Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with G.B. Nagar P.S. Case No. 48 of 2020, registered under Sections 30(a), 36, 38 and 41(i) of the Bihar Excise Act. The accusation is that on receiving secret

No.25760 of 2020(2) dt.13-10-2020 2/3 information about carrying of illicit liquor loading on trolley, the informant along with other police personal reached at the Jin Baba Temple then saw that one tractor was parked there. Thereafter, they started to search the driver of the tractor then one person was apprehended as driver of the tractor, who disclosed his name as Amarjeet (petitioner). On query, from the concealed chamber of the tractor, 96 bottles each containing 750 ml, 1320 bottles each containing 375 ml, 2208 bottles each containing 180 ml, in the volum of 964 litres, recovered. Learned counsel for the petitioner submits that petitioner is neither the owner of the said tractor nor he was apprehended from the tractor, in fact, petitioner was passing through N.H. 73 road then at that time, he was apprehended mere on suspicion as driver of the tractor. It is further submitted that petitioner has no criminal antecedent and is in custody since 27.02.2020.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge Excise, Siwan, in connection with G.B. Nagar P.S. Case

Patna High Court CR. MISC. No.25760 of 2020(2) dt.13-10-2020 3/3 No. 48 of 2020. Out of two sureties, one surety must be the close relative of the petitioner.
