The present petition has been filed seeking the following reliefs :- "(i) For issuance of an appropriate writ/order or direction(s) for commanding and directing the respondent authority to grant the benefits of second ACP to the petitioner no.1 w.e.f. 1/4/2006 and also to the petitioner no.2 and 3 with effect from w.e.f. 1.10.2007 and 20.11.2006 respectively on the ground that the petitioners have completed their services for about 29, 28, 28 years and

Patna High Court CWJC No.19336 of 2015(2) dt.22-09-2023 2/3 they are entitled for benefits of 2nd ACP as per circular of Finance with interest @ 10% per annum.

(ii) For issuance of appropriate writ/order or direction(s) for directing and commanding the responding authorities to fix pay scale of the petitioners no.2 and 3 in the same scale of 15,000-39100/- in grade pay of Rs. 6600/- from grade pay of Rs. 5400/-.

(iii) For issuance of appropriate writ / order or direction(s) for directing and commanding the respondent authorities to fix the salary of petitioner no.1 in the grade pay of Rs. 6600/- in the same scale of PB-03- 15600-39100/-. "

At the outset, the learned counsel for the petitioners fairly submits that as far as petitioners no. 1 and 2 are concerned, their grievances have already stood redressed, however petitioner no. 3 be granted liberty to approach the Director, Agriculture, Bihar, Patna i.e. the respondent no. 3 for redressal of his subsisting grievances, if any. Liberty so sought, is granted.

It is needless to state that in case, the petitioner no. 3 approaches the respondent no. 3 by filing appropriate petition within a period of three weeks from today, the respondent no. 3 shall consider the same and pass a reasoned

Patna High Court CWJC No.19336 of 2015(2) dt.22-09-2023 3/3 and a speaking order, in accordance with law, within a period of 5 weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
