JUSTICE SUDHIR SINGH ORAL ORDER 08-03-2016 Heard learned counsels for the petitioners, informant and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Karandey P.S. Case No. 13 of 2015 for the offences instituted under Sections 302/34 of the IPC. The prosecution story, in brief, is that when the informant's wife protested for putting dung on her wall she was abused, assaulted and threatened. It is alleged that whole family members of co-accused Tulsi Yadav began to assault. Tulsi Yadav assaulted on the head of the informant's wife by lathi and petitioners and others were also assaulted the informant's wife. She was also dragged by catching her hair by petitioner no. 2. She was left by assuming that she has died. Thereafter, the victim was brought to doctor at Sheikhpura for treatment from where she was

Patna High Court Cr.Misc. No.56307 of 2015 (4) dt.08-03-2016 2/2 referred to Patna but on the way she died.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is admitted enmity between the parties. The petitioners are the ladies. The police after investigation had not sent up the petitioners for trial but the learned court below differed with the said police report and has not taken cognizance under Sections 302/34 of the IPC. On behalf of the learned counsels for the informant and the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Karandey P.S. Case No. 13/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 2nd, Sheikhpura, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
