The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 188, 147, 353, 148, 149 and 435 of the Indian Penal Code. Learned counsel for the petitioners submits that so far the petitioners are concerned, the allegation is general and omnibus in nature whereas specific allegation is against coaccused Nanhak Paswan. It is claimed that petitioners are having clean antecedent.

Having regard to the facts and circumstances of the case, let the petitioners, namely, Uday Bind and Yamuna Bind be released on bail in the event of their arrest/surrender before the court below within a period of six weeks from today in

Patna High Court Cr.Misc. No.37808 of 2016 (2) dt.19-09-2016 2/2 connection with Chenari P.S. Case No. 68 of 2015, on furnishing bail bonds of Rs.10,000 (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram (Rohtas), subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.

However, at the time of accepting bail bond, the court below would verify and assure itself regarding the criminal antecedent of the petitioners. If they are having clean antecedent then their bail bonds would be accepted. If they are found to be involved in any other case before 19.08.2016 then they would be taken in custody.
