Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise (Amendment) Act, 2018/Bihar Prohibition and Excise Act, 2016.

Submission is that 31 liters of foreign liquor was allegedly recovered from the house of co-accused-Kuldip Yadav and the petitioner was also there, hence, he was apprehended in this case. Petitioner has got identical criminal antecedent.

Considering the entire facts, let the petitioner, above named, be released on bail after completion of

Patna High Court CR. MISC. No.26491 of 2019(2) dt.23-04-2019 2/2 investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Special Case No.3029 of 2019 arising out of Alamganj P.R.Case No.258 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
