JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-07-2023 The present writ petition has been filed seeking the following reliefs:- " (i) For quashing the order dated 9.9.2013 contained in Memo No.1086 issued by the District Education Officer Aurangabad by which show cause filed by the petitioner has been rejected without any valid and reasonable ground and Respondent no.3 1.e. District Programme Officer has been directed to dismiss the petitioner from her service i.e. from post of night-guard as well as as recover the salary from the date of her joining to 15 July 2013.

(ii) For quashing the order dated 20/9/2013 issued by District Programme

Patna High Court CWJC No.24111 of 2013(2) dt.05-07-2023 2/2 Officer, Aurangabad by which service of the petitioner has been cancelled with effect from 20.10.2013 and in pursuance of the order issued by Respondent no. 2 an order has been passed by B.E.O., Barun to deposit salary amount from joining to till date.

(iii) For a direction to the respondent to keep the petitioner in service with all consequential benefits for which she is entitled."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge that portion of the order dated 20.09.2013, passed by the District Programme Officer, Primary Education and Sarb Shiksha Abhiyan, Bihar Education Project, Aurangabad, by which it has been directed to recover the salary paid to the petitioner with effect from the date of her joining i.e. from the month of July, 2013, by filing appropriate appeal.
