The petitioners seek regular bail in connection with Murar P.S. Case No. 07 of 2021 instituted for the offence under Section 392 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are in custody since 09.03.2021 and charge-sheet has been submitted in the case.
Learned counsel for the petitioners submits that informant in the F.I.R. has alleged that on 30.01.2021 when the informant, who runs C.S.P. of Bank of India, was returning to his home Sowa after closing the C.S.P. then three persons on a

No.37080 of 2021(2) dt.07-12-2021 2/3 white Apache motorcycle overtook him and one of the three persons took out his country-made pistol and pointed towards him and snatched his bag containing Rs. 2,80,000/-, a laptop and a mobile phone of Vivo company and thereafter all the accused fled away.
Learned counsel for the petitioners submits that F.I.R. is against unknown and the petitioners were arrested based on the information given to the police by it's spy. It is further submitted that on being arrested, the petitioners confessed their guilt in presence of the police and their confessional statement was recorded. Learned counsel further submits that no incriminating article has been recovered from the possession of the petitioners and the petitioners have not been put on T.I. parade till date.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.
Considering the fact that the petitioners are in custody since 09.03.2021, charge-sheet has been submitted in the case and they have not been put on T.I. parade till date, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each to the satisfaction of learned

Case No. 07 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C. with a condition that the petitioners will mark their attendance in the concerned police station in between 20th to 25th of every month commencing from January 2022 till the charges are not framed and in the event if the police reports to the learned court below that that petitioners in between 20th to 25th of any of the month have not marked their attendance till the charges are framed, the learned court below will be at liberty to cancel their bail bonds.
