The petitioner seeks bail in connection with Mokama P.S. Case No. 52 of 2019 instituted for the offence under Section(s) 30(a) of Bihar Prohibition & Excise (Amendment ) Act, 2018.
Learned counsel for petitioner has submitted that petitioner is mother of co-accused Arvind Kumar. It is alleged in the written report that police got information that Arvind Kumar and his mother are keeping huge quantity of liquor in their house. The informant surrounded the house, but Arvind Kumar managed to escape and his mother was present there. Thereafter, in presence of two independent witnesses the house was searched from which 250 litres of
Patna High Court CR. MISC. No.27251 of 2019(2) dt.26-04-2019 2/2 country made liquor and 9 litres of foreign liquor have been recovered.
Petitioner is in custody since 20.03.2019 having clean antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise Act), Patna in connection with Special Case No. 3049 of 2019 arising out of Mokama P.S. Case No. 52 of 2019, subject to the condition that both the bailors shall be the close relative of the petitioner.
