JUSTICE ARUN KUMAR ORAL ORDER 31-10-2017 The petitioner has moved this Court under Section 407 Cr.P.C. for transferring Sessions Trial No.122 of 2017 from one sessions court to another but it appears that no such rejection order is on the record.
In view of Section 407(2) Cr.P.C., this application is not maintainable unless the application is disposed of by the sessions judge, so the petitioner may approach the sessions court and move a petition for transfer, which shall be disposed of expeditiously. In the meantime, further proceeding in Sessions Trial No.122 of 2017 shall remain stayed for a fortnight from the date of receipt of the order or till the petitioner files the application for transfer, whichever is earlier.
The application stands disposed of.
