JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-08-2017 The petitioners are apprehending their arrest in connection with Rajepur P.S. Case No. 63 of 2007, registered for offences punishable under Sections 147, 148, 149, 323, 324, 307, 379 of Indian Penal Code.

Allegation against the petitioners is of assaulting the informant and his father.

It appears from perusal of record that earlier the petitioners were police bail but after cognizance, they have not appeared and after lapse of nine years, they have now come for anticipatory bail.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and

No.37157 of 2017 (2) dt.19-08-2017 circumstances of the case and the conduct of the petitioners, I am not inclined to grant the petitioners the privilege of anticipatory bail, let petitioners surrender before the court below and make prayer for regular bail and if any such application is filed the court below after considering the materials available on record and also considering the fact that earlier the petitioners were on police bail, shall pass an appropriate order, without being prejudiced by the order of this Court.

With the above observation, this application is disposed of.
