Petitioners apprehend their arrest in a case registered for the offence punishable under sections 324, 379, 307, 354 of
Patna High Court CR. MISC. No.27527 of 2023(2) dt.11-07-2023 2/3 the Indian Penal Code and 3⁄4 Dian Act 1999.
On the alleged date and time of occurrence all the accused persons including these petitioners armed with weapons conjointly came at Darwaja of the informant and started abusing her and petitioner No 1 Lalan mahto abused her saying Dian, petitioner No 2 Brijkishore Mahatyo inflicted sword blow upon the head of the informant causing cut injury. It is further alleged that on protest from family members of the informant, all the petitioners assaulted them and petitioner No 3 and 4 snatched away Mangalsutra worth Rs. 25000/- from the daughter of the informant Subhwati Devi.
It is submitted that due to pending land dispute between the parties a simple occurrence of maarpeet took place between them. Injury caused by these petitioners is simple in nature. Case and counter case. Petitioners claim clean antecedent.
Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned chief Judicial Magistrate, Gopalganj in connection
