On behalf of Union of India preliminary objection has been raised as to maintainability of the writ application before this Court, as the grievance is against the Union of India and for which appropriate forum would be the Central Administrative Tribunal.

Considering the preliminary objection raised by the respondents, the Court finds substance and the writ application

Patna High Court CWJC No.9595 of 2019(6) dt.12-11-2020 2/2 is disposed of with liberty to the petitioner to approach the Central Administrative Tribunal.

In the event, there is delay in filing Original Application before the Central Administrative Tribunal, the petitioner would be well advised to file appropriate affidavit intimating the fact that he was availing the remedy of writ application.

The Court hope and trust that the Central Administrative Tribunal will do well in deciding the Original Application, if filed by the petitioner, at the earliest. With the aforesaid, the writ application stands disposed of.
