Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 379, 411, 353/34 of the Indian Penal Code and 17 of the Railway Act.

Accusation is of committing theft of coal from the railway rack.

It is submitted by the learned counsel for the petitioners that there is no recovery from the possession of the petitioners. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent. The aforesaid facts constitute ground for consideration of prayer for regular bail of the petitioners, if the

Patna High Court Cr.Misc. No.1267 of 2016 (2) dt.11-01-2016 petitioners surrender before the learned court below within a period of six weeks from today in connection with Kahalgaon P.S. Case No. 350 of 2015, pending in the court of learned J.M., Ist Class, Bhagalpur.

With this observation this application is disposed of.
