JUSTICE MUNGESHWAR SAHOO ORAL ORDER 08-12-2015 Heard the learned counsel, Mr. Mritunjay Prasad Singh, for the petitioner and the learned counsel Mr. Umesh Tiwary, on behalf of the respondent on the interlocutory application No.9046 of 2015.

At the time of hearing of the interlocutory application, both the learned counsels submitted that the writ application itself may also be heard on merit in admission matter. Accordingly, I heard them on merit in admission matter.

By the impugned order dated 03.12.2014, the Addl. Sessions Judge, East Champaran, Motihari dismissed the title appeal No.63 of 2001.

From perusal of the impugned order, it appears that the Court below found that when the appeal was called on for hearing, nobody appeared on behalf of the appellant and that the earlier order passed by the Court below have not been complied

Patna High Court CWJC No.1857 of 2015 (2) dt.08-12-2015 2/2 with. Therefore, in supervisory jurisdiction, the impugned order cannot be interfered with. Thus, this writ application is dismissed. (Mungeshwar Sahoo, J) Sanjeev/- U
