JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 09-11-2015 Order under challenge is dated 21.04.2014. This is the order passed by the Special Director, Secondary Education, Government of Bihar where the grievance of the petitioner against the constitution of an ad hoc committee by Sanskrit Shiksha Board has been rejected by the Special Director while hearing Appeal No.2 of 2013.
On perusal of Annexure-10, it is evident that a claim has
Patna High Court CWJC No.13716 of 2014 dt.09-11-2015 2 / 2 been made by the petitioner who was appellant before the Special Director claiming status of a Secretary of a committee. The Special Director after having heard the matter on several dates gave an opportunity to the counsel to produce evidence in support of her claim. Nothing of that kind had been done, therefore, the appellate authority came to a considered opinion that the petitioner lacks locus and is more of a busy body if not a self proclaimed Secretary. Counsel for Sanskrit Shiksha Board takes yet another plea which is that notices had been given before the constitution of the ad hoc committee. When no response came based on the materials and inputs available, ad hoc committee was constituted even otherwise the life of an ad hoc committee is restricted to six months, therefore, the entire dispute has come to not because yet another ad hoc committee has been constituted after the expiry of the previous one which led to initiation of Appeal No.2 of 2013.
The position being such, no interference is warranted with the impugned order Annexure-10.
Writ is dismissed.
