The petitioner is apprehending arrest in connection with Ahiyapur P.S. Case No. 1119 of 2019 for the offences under Sections 272 and 273 IPC and Section 30(a), 36/38 of the Bihar Prohibition and Excise Act.

In the instant case there is recovery of 2116.800 liters of liquor.

Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. The name of the petitioner was disclosed by co-accused during the course of seizure.

Considering the fact that the petitioner has no criminal antecedent, the Court is inclined to grant anticipatory

Patna High Court CR. MISC. No.27700 of 2020(2) dt.26-11-2020 2/2 bail to the petitioner on deposit of cash of Rs. 1,00,000/-. Let the petitioner, above named, in the event of arrest or surrender within four weeks from the date of communication of the order, be released on bail on furnishing bail bond of Rs. 1,00,000- (one lac) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Muzaffarpur in connection with Ahiyapur P.S. Case No. 1119 of 2019, subject to deposit of cash of Rs. 1,00,000/- and further subject to the conditions as laid down under Section 438(2) Cr. P. C.
