Heard learned counsel for the petitioner and Ms. Rina Sinha, learned APP for the State.

Petitioner in the present case is seeking pre-arrest bail in connection with Bochahan P.S. Case No.336/2019 for the offence under Sections 324, 341, 379 and 307/34 of the Indian Penal Code.

Learned counsel for the petitioner has though submitted that the petitioner has been falsely implicated in this case, but on perusal of the First Information Report it would appear that there is specific allegation of causing assault against

After some argument learned counsel for the petitioner, therefore, seeks permission to withdraw this application with liberty to surrender and pray for regular bail in the court below. Ms. Rina Sinha, learned APP for the State has no objection to the same.

In the facts and circumstances of the case, this application is permitted to be withdrawn uncondtionally with liberty to the petitioner to surrender in the court below and pray for regular bail. In case the petitioner surrenders and prays for regular within a period of four weeks from today, his prayer for regular bail shall be considered on its own merit without being prejudiced by the order of this Court.

The observations of this Court to surrender in the court below shall not be construed as granting any interim protection to the petitioner for the aforesaid period. This application stands disposed of.
