JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard leaned counsel for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 270, 272 and 290 of the Indian Penal Code and 47(a) of the Excise Act. It is alleged that from the motel of the petitioner foreign liquor of different brands and 10 litres of country made liquor were recovered.
It is submitted by the petitioner that petitioner was not present at the place of seizure at the time of recovery and the recovery is of small quantity. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute ground for
Patna High Court Cr.Misc. No.57967 of 2015 (2) dt.04-01-2016 2/2 consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner, if he surrenders within a period of six weeks in connection with Sahebganj P.S. Case no. 248/2015, pending before the learned Sub-Divisional Judicial Magistrate (West), Muzaffarpur.
With the above observation, this application is, accordingly disposed off.
