JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner is apprehending his arrest in connection with Rajapakar P.S. Case No. 92 of 2016 for the offences instituted under Sections 363 and 366(A) of the Indian Penal Code.
The allegation against the accused persons including the petitioner is of committing abduction of two girls. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. He has falsely been implicated in the present case. Both the victim girls have been examined under Section 164 Cr.P.C. There is no
Patna High Court Cr.Misc. No.51379 of 2016 (2) dt.05-12-2016 2/2 allegation of inducement or any sexual or physical abuse alleged against the petitioner.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R. though no overt act has been alleged against the petitioner in the 164 Cr.P.C. statement of the victims.
Considering the aforesaid facts and circumstances, I am not inclined to extend the privilege of anticipatory bail to the petitioner. The same is rejected in connection with Rajapakar P.S. Case No. 92 of 2016, pending in the Court of learned A.C.J.M.- VII, Vaishali at Hajipur.
Anyhow if the petitioner surrenders in the court below within a period of six weeks from today, the same shall be considered on its own merit without being prejudiced by this order.
