The petitioner apprehends his arrest in connection with Sahodara P. S. Case No. 30 of 2017 instituted under Sections 379/34 of the Indian Penal Code.
The allegation, in brief, is that the District Mining Officer found that some persons are doing mining of stone chips and the names of the accused persons were disclosed by the villagers.
Submission is that petitioner was not found doing any mining nor anything was recovered from his possession, except general allegation that his name is disclosed by the villagers and there is no other material and the petitioner has got no criminal antecedent.
Patna High Court Cr.Misc. No.39264 of 2017 (3) dt.17-10-2017 2/2 Having considered the aforesaid facts and circumstances, let the petitioner, namely, Birendra Mahto, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Bettiah, West Champaran, in connection with Sahodara P.S.Case No. 30 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
