The petitioner apprehends his arrest in connection with Tekari P.S. (Panchanpur) Case No.217 of 2016 registered under Sections 366(A) and 120-B of the Indian Penal Code, pending in the court of the Additional Chief Judicial Magistrate-VI, Gaya. The accusation is of kidnapping the married daughter of the informant by the co-accused Nagendra Thakur with the help of this petitioner and one Shankar Sao.
Learned counsel appearing on behalf of the petitioner submits that due to suspicion, the petitioner has been made accused in this case with Shankar Sao and, later on, on the pressure of the family members, the victim also disclosed the name of this petitioner having his hand in her kidnapping in her
Patna High Court Cr.Misc. No.52798 of 2016 (2) dt.06-12-2016 2/2 statement as recorded under Section 164 of the Code of Criminal Procedure.
Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
