Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
This application for grant of anticipatory bail arises out of Karjain P.S. Case No. 57 of 2015, disclosing offences under Sections-363, 366A/34 of the Indian Penal Code. It is alleged in the first information report that coaccused, Kanchan had developed amorous relation with the informant's daughter, who is missing since 17-07-2015. The first information report came to be instituted on 24-09-2015, raising suspicion that the said Kanchan Kumar might have kidnapped the daughter of the informant, for marriage.
Patna High Court Cr.Misc. No.57110 of 2015 (5) dt.23-06-2016 2/2 Learned counsel for the petitioner appears to be right in his submission that there is no allegation of any overt act against the petitioner of any nature and only allegation against him is that he is a friend of said Kanchan Kumar.
Considering the above-said facts and circumstances, this application is allowed.
Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-Ist Class, Birpur (Supaul) in connection with Karjain P.S. Case No. 57 of 2015, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
