====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-11-2022 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner apprehends his/her arrest in a case registered for offence punishable u/s 147, 149, 341, 323, 308, 354, 504, 506 IPC.

Allegedly, on account of some altercation, the accused persons named in F.I.R. including the petitioner assaulted the informant with leg, fist and lathi and threatened her of dire consequences. The petitioner also tried to outrage the modesty of the informant.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case due to land dispute. No such occurrence, in the manner as alleged, has ever taken place.

It is further submitted that the petitioner is agnate and co-sharer of the informant and there is previous dispute between them with regard to ancestral property. The injuries received by the informant is grievous in nature. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. Considering the facts and circumstances of the case as well as the fact that the injury is grievous in nature, I am not inclined to enlarge him on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. This application is accordingly dismissed.
