2. The present criminal miscellaneous application has been filed for modification in the order dated 19.03.2024 bearing Cr. Misc. No.83091 of 2023.

3. Counsel for the petitioner submits that by the said order, the bail application of the petitioner was allowed and granted regular bail, but due to misinformation by the Pairwikar in Para-3 of the bail petition, wrong case no. i.e., Lakhisarai (Ramgarh Chowk) P.S. Case No.671 of 2018 has been typed in place of Lakhisarai (Ramgarh Chowk) P.S. Case No.67 of 2018 and due to this reason, wrong case no. has been inserted in Page 3(3) (V) of the order sheet and due to this mistake, the petitioner is still in custody.

4. As such, counsel for the petitioner submits that the said Lakhisarai (Ramgarh Chowk) P.S. Case No.671 of 2018 be

Patna High Court CR. MISC. No.34924 of 2024(2) dt.03-05-2024 2/2 corrected as Lakhisarai (Ramgarh Chowk) P.S. Case No.67 of 2018. He further submits that the petitioner has been granted regular bail on 19.03.2024.

5. Counsel for the State submits that order may be modified.

6. In the present facts and circumstances, due to miscommunication by the Pairwikar, wrong has been made, but in the present criminal miscellaneous, correct case no. has been described which is in paragraph 4 of the present bail application.

7. In this background, let the Lakhisarai (Ramgarh Chowk) P.S. Case No.671 of 2018 shall be read as Lakhisarai (Ramgarh Chowk) P.S. Case No.67 of 2018 as mentioned in page 3(3) of the order dated 19.03.2024 passed in Cr. Misc. No.83091 of 2023.

8. Accordingly, the order dated 19.03.2024 is hereby modified upto to the extent and the present modification application is hereby allowed.
