The present petition has been filed seeking the following relief :- "(i) For issuance of appropriate writ in the nature of writ of mandamus commanding the respondents to grant the A.C.P./ Promotion to the petitioner who was appointed on the post of Machine Man-cum-Operator on 23.06.1984 and after three years, his service was confirmed since 23.06.1987. "

The learned counsel for the respondent State has referred to the counter affidavit filed in the present case to
Patna High Court CWJC No.23955 of 2013 dt.05-07-2023 2/2 submit that after the meeting of the Screening Committee of the Department was held on 19.08.2016, recommendation was made in favour of the petitioner, whereafter, the Director, Agriculture, Bihar, Patna has issued an office order dated 29.09.2016, whereby and whereunder the petitioner had been granted the benefits of 1st and 2nd A.C.P. w.e.f. 09.08.1999 and 23.06.2008 respectively, hence, it is submitted that the present writ petition has been rendered infructuous during the interregnum period.

Having regard to the fact and circumstances of the case, I deem it fit and proper to dispose off the present writ petition with a direction to the Director, Agriculture, Bihar, Patna to ensure that the monetory benefits arising out of the order dated 29.09.2016, granting 1st and 2nd A.C.P. to the petitioner w.e.f. 09.08.1999 and 23.06.2008, are paid within a period of six weeks from today, in case the same have not yet been paid.
