JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 307, 448, 379 and 504 of the Indian Penal Code. The prosecution case is that co-accused Md. Moin came and started abusing for not allowing his son to play cricket and on protest being made, he called his son-in-law and grand son and order them to kill and rob the informant then Md. Jilani came with farsa and assaulted on the head of Md. Nihaluddin and Md. Sakir assaulted with Khanti. It is further alleged that Md. Samshad and Md. Soaib assaulted the informant with hockey stick and iron rod. It is also alleged that the petitioner and Samsad also assaulted with lathi.

No.56381 of 2015 (2) dt.11-12-2015 2/2 It is submitted by learned counsel for the petitioner that the informant has received only one bruise simple in nature caused by hard and blunt substance. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the accusation not being corroborated by medical opinion, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gaya in connection with Belaganj P.S. Case No. 117 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
