====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-06-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a), 32(2) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 2803.08 litres illicit liquor was recovered from the seized truck. It is alleged that the recovered liquor was to be delivered to one Master Sahab and whose mobile no. is 9341219607. Petitioner is alleged to be owner of the aforesaid sim number.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been made accused merely because she is owner of sim no. 9341219607. No incriminating material has been recovered from conscious possession of the petitioner. Petitioner is neither driver nor owner of the truck in

Patna High Court CR. MISC. No.30644 of 2025(3) dt.23-06-2025 2/2 question and has got no concern with the alleged recovery. Petitioner is lady and claims clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of her arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-II, Banka in connection with Banka (Barahat) P. S. Case No. 528 of 2021, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
