2. The petitioner seeks regular bail in connection with Fatuha P.S. Case No.422 of 2022, lodged on 13.06.2022 under Sections 363 and 365/34 of the Indian Penal Code.

3. As per the prosecution case, co-accused, Raushan Kumar, Vikash Kumar, Santosh Kumar and Rajnish Kumar got the son of the informant seated in their vehicle bearing registration No. BR01PD-5100 and went from his house. Thereafter, the son of the informant did not return and his mobile phone was found switched off. Whereupon the informant raising suspicion lodged the present case against four named accused persons alleging therein that they have kidnapped his son with an intention to kill him.

Learned counsel for the petitioner submits that though the petitioner is named in the FIR, but his name has figured on the basis of confessional statement of co-accused, Kundan Kumar who has been granted regular bail by a coordinate Bench of this Court vide order dated 03.05.2023 passed in Criminal Miscellaneous No. 73747 of 2022. He further submits that the antecedent of the petitioner is clean and he is in custody since 17.06.2022.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Patna City in connection with Fatuha P.S. Case No. 422 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C. (Dr. Anshuman, J) Ashwini/- U
