The petitioner is apprehending arrest in connection with Sonepur P.S. Case No. 308 of 2020 for offences under Sections 304(B), 201, 34 IPC. In the instant case one Moni Devi filed a complaint stating therein that her sister was got married on 2.12.2010 according to Hindu rites. In April 2020 she received information about killing of her sister and also that accused persons had disposed of the dead body and the FIR was lodged in the aforesaid background.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The petitioner is living separately and has no concern with the other brother in day to day affairs. The deceased was married to Vikramaditya Rai and this petitioner has no concern with their affairs. In addition thereto the marriage took place in 2012 beyond seven years.

Patna High Court CR. MISC. No.27628 of 2020(3) dt.12-01-2021 2/2 Counsel further submits that irrespective of the date of marriage the petitioner has no concerned with the affairs of the husband and wife and the petitioner is not even remotely concerned with the death of Moni Devi.

Considering the fact that the petitioner is residing separately, the Court is inclined to grant privilege of anticipatory bail to the petitioner on deposit of cash of Rs. 25,000/-. Let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the CJM, Saran at Chapra in connection with Sonepur P.S. Case No. 308 of 2020, subject to deposit of Rs. 25,000/- cash and further subject to the conditions as laid down under Section 438(2) Cr. P. C.

The deposit of cash of Rs. 25,000/- shall abide by the final out come of the present criminal case.
