JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 406, 420 and 120 of the Indian Penal Code.

The prosecution case is that co-accused Md. Sikandar and Bablu who claimed to be working with one Md. Fanus in a non-banking company, persuaded the informant to invest when informant went to the house of Md. Fanus in company of above two persons with Rs. five lakhs but he was not there when the money was handed over to Md. Sikandar but subsequently neither the informant received the doubled the investment amount as assured by co-accused Md. Sikandar and Bablu nor actual investment amount, subsequently Md. Fanus committed suicide. It is submitted by learned counsel for the petitioners that

Patna High Court Cr.Misc. No.56365 of 2015 (2) dt.11-12-2015 2/2 the petitioner has been roped in the present case simply because he happens to be the unfortunate father who committed suicide. From perusal of the FIR, it appears that the petitioner neither persuaded the informant to make investment nor he received the money. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnea in connection with Janki Nagar P.S. Case No. 98 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
