JUSTICE SANJAY PRIYA ORAL ORDER 21-02-2018 This application has been filed for modification of the order dated 1.12.2017 passed in Cr. Misc. no. 56793 of 2017 by which prayer for anticipatory bail of the petitioner was rejected.

Learned counsel for the petitioner has submitted that prayer of the petitioner for anticipatory bail was rejected by order dated 01.12.2017 vide Cr. Misc. no. 56793 of 2017 with direction to surrender along with the victim girl before the Court below within a period of four weeks from the date of receipt of the order.

It has further been submitted that the Court of learned C.J.M. Banka was vacant and therefore the petitioner could not surrender in terms of the aforesaid order.

Accordingly, four weeks further time from the date of

Patna High Court Cr.Misc. No.9840 of 2018(2) dt.21-02-2018 2/2 receipt of a copy of this order is given to the petitioner to surrender in the Court below in terms of the order dated 01.12.2017 passed in Cr. Misc. no. 56793 of 2017. This Cr. Misc. application is allowed.
