The petitioner seeks bail in Sessions Trial No. 299 of 2018 arising out of Hajipur Town P.S. Case No. 114 of 2017, instituted for the offence under Section(s) 382 of the Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. Petitioner has been arrested merely on suspicion and thereafter Police has recorded his confessional statement. He further submits that other co-accused have already been granted bail by coordinate Benches of this Court vide orders dated 14.08.2018, 9.8.2018 and 3.12.2018 passed in Cr. Misc.
Patna High Court CR. MISC. No.31404 of 2019(2) dt.10-05-2019 2/2 31889 of 2018, 41963 of 2018 and 68870 of 2018 respectively. Petitioner is in custody since 6.12.2018.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-Xth, Vaishali at Hajipur, in connection with Sessions Trial No. 299 of 2018 arising out of Hajipur Town P.S. Case No. 114 of 2017, subject to the condition that both the bailors will be close relatives of the petitioner.
