2.The petitioner has preferred this application for grant of regular bail in connection with Kuchaikote P.S. Case No. 508 of 2024 dated 28.11.2024 registered for the offence punishable u/s 310(2) of the B.N.S.

3. As per the prosecution case, on 28.11.2024, when the informant was returning after collection of Rs. 4,40,000/- (Rs. Four lac forty thousand), six unknown accused persons came on three motorcycles, on the point of gun, looted the money and a Splendor motorcycle from the informant and fled away.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.28826 of 2025(2) dt.14-05-2025 2/3 that the petitioner is innocent and has falsely been implicated in this case on suspicion. The petitioner is not named in the FIR. His name has transpired in this case on the confessional statement of co-accused Dharmendra Bin and Uma Shankar Ram. The looted Splendor motorcycle has been recovered from possession of the co-accused Sonu Miya and Samsuddin. There is no recovery made from conscious possession of the petitioner. The petitioner has nine criminal antecedents in which he is on bail in all cases as stated in para 3 of the bail petition. The petitioner is in custody since 16.12.2024. The co-accused person has already been granted regular bail by this Court vide order dated 30.04.2025 passed in Cr. Misc. No. 23113 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gopalganj in connection with Kuchaikote P.S. Case No. 508 of 2024, with a condition:- (i) The petitioner is directed to remain physically
