1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application has been filed for modification of the order, dated 20.02.2025, passed in Criminal Misc. No. 3286 of 2025, whereby the present petitioner has been granted privilege of anticipatory bail subject to the condition that the petitioner shall surrender before the learned Court below within a period of four weeks from the date of the order.
3. Learned Counsel for the petitioner submits that due to inadvertence, the case number has wrongly been mentioned in the bail application, i.e. Criminal Misc. No. 3286 of 2025, as Excise Police Station Case No. 518 of
Patna High Court CR. MISC. No.29702 of 2025(2) dt.02-05-2025 2/2 2024 in place of Excise Police Station Case No. 518 of 2020 and due to such mistake, the wrong case number has been mentioned in the order, dated 20.02.2025, and due to this, the petitioner could not surrender before the learned Court below within the time granted by this Court. He accordingly prays for necessary modification/correction in the order, dated 20.02.2025, passed in Criminal Misc. No. 3286 of 2025 and further for granting two weeks' more time to surrender before the learned Court below.
4. Having regard to the submissions made on behalf of the petitioner, let Excise Police Station Case No. 518 of 2024, appearing in the order, dated 20.02.2025, passed in Criminal Misc. No. 3286 of 2025 be read as Excise Police Station Case No. 518 of 2020 and the time granted by this Court to surrender before the learned Court below by order, dated 20.02.2025, is hereby extended by further two weeks from today, subject to payment of Rs. 1,000/- in the account of District Legal Services Authority, Gaya.
