The writ petition has been filed for quashing of the letter dated 2.9.2013 issued by the Child Development Project Officer (CDPO) Begusarai, whereby and where under the petitioner's claim for issuance of selection letter as Anganwari Sevika for the centre no. 35 has been rejected.

Learned counsel for the petitioner submits that the entire process of selection was conducted in accordance with law after due

Patna High Court CWJC No.13162 of 2014(4) dt.16-07-2019 2/2 notice on the notice board and therefore the non-issuance of selection letter by the authority concerned and rejection of his for appointment as Anganwari Sevika is unsustainable.

The respondents have also filed a counter affidavit the facts which has been highlighted in the counter affidavit that the petitioner claims that Aamsabha was conducted on 15.5.2010 however the letter for proceeding on training was issued by the Member Secretary on 13.5.2010. It is also pointed out that the CDPO had not participated and consented to the selection process and therefore in terms of the guidelines the Aamsabha was not properly constituted. Fact that in the meantime, a third person has been selected for Aanganwari Sevika for Centre no. 35 has also been placed on record.

Till date there is no rejoinder or reply to the specific stand taken by the respondent in the counter affidavit, has been filed. The newly selected Sevika has already been working on centre no. 35. Having regard to the aforesaid situation, this court does not find any reason to interfere with the letter dated 2.9.2013. Writ petition is devoid of merit, petition is dismissed.
