JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-07-2022 Earlier, vide order dated 30.06.2022, on the submission of learned counsel for the petitioners, the present petition in respect of petitioner no. 1 and 2 has stood dismissed as withdrawn.

Now, prayer for anticipatory bail of petitioner no. 3: Petitioner apprehends his arrest in a case registered for the offence punishable under Section 307 & other allied sections of the Indian Penal Code.

The allegation against this petitioner is that he assaulted informant's wife with lathi and broke her hand and also removed gold chain.

Patna High Court CR. MISC. No.27124 of 2022(3) dt.14-07-2022 2/2 It is submitted that due to land dispute between the parties, the entire family members of the petitioner have been made accused. As a matter of fact, in order to grab the land, the informant has implicated all the family members of petitioner. In fact, simple scuffle took place on the date of alleged occurrence, but the informant has converted it into a serious offence.

However, learned counsel for the informant vehemently opposes the prayer for anticipatory bail and submits that there is specific allegation of assault against petitioner (Anshu Kumar @ Mithu) as a result of which, hand of informant's wife got fractured and injury is grievous in nature. Considering the nature of allegation and injury, the prayer for anticipatory bail of petitioner / Anshu Kumar @ Mithu is rejected.
