The petitioner, being the husband of the informant, apprehending arrest in a case registered under Sections 341, 323, 498A and 506/34 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.

The basic accusation is of torture for non-fulfillment of dowry demand. It is alleged that the petitioner made an attempt to cause burn injury by pouring kerosene oil. It is submitted by the learned counsel for the petitioner that the thrust of accusation is against the husband of the petitioner. The husband of the informant has reconciled the issue and on the basis of reconciliation the husband of the informant has been granted anticipatory bail by the order of the Session's Judge, certified copy of which has been produced, let it be kept on record. It is, further, submitted that there is nothing on record to suggest that any injury was caused to the informant.

Hence, having regard to the facts and circumstances of the case, the petitioner, above named, in the event of arrest or

No.37163 of 2016 (2) dt.29-08-2016 surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with the Mahila P.S. Case No. 17 of 2016 to the satisfaction of the Chief Judicial Magistrate, Banka, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
