Petitioner apprehends arrest in a case registered for the offence punishable under Sections 384/34 of the IPC. As per the prosecution case, the accused persons are alleged to have taken bribe from the driver and owner of the trucks.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and his name has figured in the case on the confessional statement of the co accused who was apprehended on the spot. Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ld. Court of Sessions Judge, Jehanabad in connection with P.S. Case No. 879/2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
