JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-12-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Rajapakar P.S. Case No. 88 of 2016 for the offences punishable under sections 147, 148, 341, 323, 324, 307, 302, 504 and 506 of the I.P.C. Allegedly, Jag Narayan Paswan gave Hasuli blow on the chest of father of the informant resulting his lungs came out and he became unconscious and when on alarm the informant and others came there the petitioner and others assaulted them causing head injury to Manoj Paswan and fracture of leg to Ghuntun Kumar.

No.51522 of 2016 (2) dt.20-12-2016 2/2 specific allegation against the petitioner, specific allegation is against Jag Narayan Paswan, similarly situated other co-accused have been allowed pre-arrest bail by the learned court below itself and as such the petitioner deserves sympathetic consideration, to which the learned A.P.P. opposes.

In the facts and circumstances as stated above, the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M-VII, Vaishali at Hajipur in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
