JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 12-12-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Pupri P.S. Case No. 295 of 2016, registered under Sections 363 and 366(A) of the Indian Penal Code.

The accusation is of kidnapping the daughter of the informant by petitioner, Harish Chandra Sahni @ Harichan Kumar with the help of his mother, Deoki Devi.

Learned counsel for the petitioner submits that, in fact, daughter of the informant left her house without giving information for the house of her maternal uncle, which would appear from her statement recorded under Section 164 Cr.P.C. (annexure 2 to the petition), but mere on suspicion the informant

Patna High Court Cr.Misc. No.39855 of 2017 (3) dt.12-12-2017 has lodged the present case with false allegation. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Pupri at Sitamarhi, in connection with Pupri P.S. Case No. 295 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
