The petitioner is apprehending arrest in connection with Barhariya P.S. Case No. 51 of 2020 for the offences under Sections 272, 273 and 34 IPC and Section 30(a), 41(1) of the Bihar Prohibition and Excise Act, 2016.
In the instant case there is recovery of 1235.520 liters of liquor.
Learned counsel for the petitioner would submit that the petitioner has no criminal antecedent. This petitioner has no concern with the seized liquor. He is not involved in trade of liquor and the liquor which was recovered from the pick up van does not belong to the petitioner.
Considering the fact that the petitioner has no

No.27704 of 2020(2) dt.26-11-2020 2/2 criminal antecedent and nothing was recovered from his conscious possession, the Court is inclined to grant anticipatory bail to the petitioner on deposit of cash of Rs. 1,00,000/-. Let the petitioner, above named, in the event of arrest or surrender within four weeks from the date of communication of the order, be released on bail on furnishing bail bond of Rs. 1,00,000- (one lac) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise, Excise, Siwan in connection with Barhariya P.S. Case No. 51 of 2020, subject to deposit of cash of Rs. 1,00,000/- and further subject to the conditions as laid down under Section 438(2) Cr. P. C.
