Learned counsel for the petitioner submits that vide order dated 23.06.2022 time was granted to him to file a supplementary affidavit but as per office report supplementary affidavit has not been filed.

Learned counsel for the petitioner submits that supplementary affidavit has been filed on 10.08.2022 in the soft form. Learned counsel is providing the hard copy of the supplementary affidavit in the court itself, which is directed to be accepted and kept on record.

Learned counsel for the petitioner submits that present application has been filed for quashing of the F.I.R., but subsequently charge sheet has already been filed in this case on

Patna High Court CR. MISC. No.11339 of 2018(3) dt.02-11-2022 2/2 22.05.2019 and Trial Court has taken cognizance on 19.08.2019 under Section 409/34 of the I.P.C. as such the quashing application become infructuous, therefore, counsel seeks permission to withdraw this application.

Permission granted.

The present quashing application is dismissed as withdrawn being infructuous.
